"Reconciliation through the sacrament of Penance can be granted only to those who have repented for having violated the sign of the covenant and of fidelity to Christ, and who are committed to living in complete continence."
--Catechism 1650

Guess it depends on what your meaning of the words "repented" and "continence" are. In any case, it's obviously not as slam-dunk as you portray it.

Giuliani simply isn't the Catholic candidate he claims to be. He can't have a confessor. He can't receive the sacraments of penance, the Eucharist, or marriage.

Wrong. I don't have a problem with criticism of the Catholic Church; I have plenty of my own. But writing things that simply aren't true doesn't do anyone any good. Rudy certainly can recieve the sacrament of penance. Any baptized Catholic can. It's hard to take the rest of the critique seriously when the guy botches such a simple thing.

I am catholic. Am I supposed to leave my church over my disagreements over dogma and leave it in the hands of the great gray haired oligarchy? I'd rather be the voice of dissent. It is my church too.
